Privacy Policy

1. Who we are and what this policy covers

Cycle Intelligence ("Cycle," "we," "our," or "us") fine-tunes open-source models for businesses, and hosts and serves those models through an OpenAI-compatible API, on our managed cloud or on the customer's own infrastructure. This Privacy Policy explains how we collect, use, share and protect personal information when you visit usecycle.ai or use our products and services (the "Services").

We serve businesses, not consumers. Most personal information we handle belongs to people acting for our customers, such as account owners, team members and technical and billing contacts.

2. Customer Data

"Customer Data" is the data our customers send us or connect us to so we can build and run their models: training data such as inputs and expected outputs, data from their data warehouses, evaluation data, the prompts sent to their models, and the outputs those models return. Customer Data may contain personal information.

For Customer Data, we act as a service provider (a "processor") for our customer, who decides what data to send and why. We process Customer Data only to provide the Services to that customer, as set out in our agreement with them, including any data processing agreement. In particular:

• We use a customer's data only to select, fine-tune, evaluate, host, serve and improve that customer's own models.
• We do not use one customer's data to train or improve models for any other customer, or to train general models of our own.
• We do not sell Customer Data, or share it for advertising.
• When a customer runs its models on its own infrastructure, Customer Data processed there stays with the customer, and we access it only as the customer allows.

If you are an individual whose personal information is in Customer Data, please contact the customer who sent it to us; we will help them respond to your request.

3. Information we collect about you

We collect the following information to provide and run the Services:

• Account and contact information: name, work email address, company, role and phone number, when you sign up, request early access, book a call or write to us.
• Usage information: how you use the Services, such as API requests (their time, size, model and token counts), logs, errors and performance data, used to operate, secure and bill the Services.
• Website information: pages visited, referring pages, browser and device type, and IP address, from cookies and similar technologies when you visit our website.
• Billing information: billing contacts and payment details, which our payment provider handles.
• Communications: the messages you send us, and notes from our calls with you.

4. How we use information

• To provide, maintain, secure and support the Services
• To set up accounts, authenticate users and prevent fraud and abuse
• To measure usage and bill for the Services
• To communicate with you about the Services, including service and security notices
• To understand how our website and Services are used, and to improve them
• To comply with the law and enforce our agreements

Where the law requires a legal basis, we rely on performing our contract with you or your organization, our legitimate interests in running and improving our business, your consent where we ask for it, and our legal obligations.

5. How we share information

We do not sell personal information. We share it only as follows:

• Service providers: companies that help us run the Services, such as cloud and GPU providers that host training and serving, and providers of payments, email and analytics. They may use the information only to provide their services to us, under confidentiality and security obligations.
• At your organization's direction: for example, to tools or infrastructure your organization connects to the Services.
• Legal reasons: when the law requires it, or to protect the rights, property or safety of Cycle, our customers or others.
• Business transfers: as part of a merger, acquisition or sale of assets, with this policy continuing to apply.

Customers can ask us for the current list of service providers that process their Customer Data.

6. Security

We use administrative, technical and physical safeguards designed to protect information, including encryption in transit and at rest, access controls limited to the people who need access, and separation of each customer's data and models. No system is perfectly secure, and we cannot guarantee absolute security. If we learn of a security incident affecting your information, we will notify you as the law and our agreements require.

7. Retention and deletion

We keep Customer Data, and the models fine-tuned on it, for as long as our agreement with the customer requires, and delete or return them as that agreement sets out, including when it ends. We keep other personal information for as long as we need it for the purposes in this policy, or as the law requires, and then delete or anonymize it.

8. International transfers

We and our service providers may process information in countries other than yours. When we transfer personal information across borders, we use safeguards the law recognizes, such as standard contractual clauses. Customers can agree with us where their Customer Data is processed and stored.

9. Your rights

Depending on where you live, you may have the right to access, correct, delete or export your personal information, to object to or restrict how we use it, and to withdraw consent you have given. To use these rights, write to [email protected]. We will not treat you differently for using them. You may also complain to your local data protection authority.

10. Children

The Services are for businesses and are not directed to children. We do not knowingly collect personal information from children under 16.

11. Changes to this policy

We may update this policy. When we make material changes, we will update the date above and, where appropriate, tell our customers before the changes take effect.
